2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 364A of the Indian Penal Code.

3. As per prosecution case, the informant alleged that her nephew, namely Ramesh Kumar, who is in the business of Ayurvedic medicine, was kidnapped by the F.I.R. named accused persons and they demanded three lakh rupees, which led to lodging of the present F.I.R.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired during course of investigation.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that the victim in his statement recorded under Section 183 of the B.N.S.S. has named this petitioner and has categorically stated that he was also involved in the alleged occurrence.

6. Considering the nature of accusation and statement of victim recorded under Section 183 of the B.N.S.S., the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
