JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 29-06-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Tarabari P.S. Case No.71 of 2017, registered for offences alleged under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there are general and omnibus allegations against altogether 16 persons in the First Information Report. It is submitted that the deceased happens to be a notorious criminal and as per the FIR when the police party had gone there to arrest him he was trying to flee away. The allegation is that on asking of the office in-charge of the police station co-villagers chased the husband of the informant and then by giving indiscriminate lathi blow he was killed.

Patna High Court Cr.Misc. No.37201 of 2018 (2) dt.29-06-2018 Learned counsel submits that considering the kind of vague allegations, some of the co-accused have been granted privilege of regular bail vide Annexure-5 and 6 to the present application. The petitioner is also similarly situated.

Learned APP for the State is present.

Considering the facts and circumstances of the case where there are general and omnibus allegations and the co-villagers, who are co-accused, have been granted regular bail by learned different coordinate Benches of this Court, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Tarabari P.S. Case No. 71 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
