====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Sections 399, 402 and 414 of the IPC. The prosecution story, in brief, is that the police on secret information caught the petitioner and others alongwith a Car bearing Registration No. WB-06F-1774 and recovered Voter I. D. Smart Card, A.T.M. Card, Adhar Card, Mobile and other articles.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 23.08.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of

Patna High Court CR. MISC. No.81467 of 2019(2) dt.18-12-2019 2/2 tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner had no knowledge that the Car in question is a stolen property. He has been made accused in the present case due to mistake of fact.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Gopalganj in connection with Gopalganj Town P.S. Case No. 402 of 2019.
