1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Laheri P.S. Case no.616 of 2023 registered under sections 420, 406 and 34 of the Indian Penal Code.
3. As per the prosecution case, the informant states that while he was at his shop, the petitioner and others came there and induced him to invest his money which would give him a very high return. It is stated that at the instigation of the accused persons and on their assurance that his investment of Rs.12 lacs would become Rs.40 lacs in two months, he gave the amount to the accused including the petitioner herein. On the informant further asking for the amount, the accused further gave him 13 bottles of black paper stating that they would
Patna High Court CR. MISC. No.1564 of 2025(4) dt.11-04-2025 2/3 within a period of 10 days bring a chemical from Singpore on mixing of which the black paper would turn into gold. The informant not having received his amount back, has filed the instant case.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. On bare reading of the contents of the FIR itself, it would transpire that the allegations are not only false and fabricated but unrealistic. The petitioner is in custody since 25.10.2024, has no criminal antecedent and chargesheet has been submitted in the case. Several co-accused have been enlarged on bail vide order dated 16.1.2024 passed in Cr. Misc. no.667 of 2024, order dated 26.4.2024 in Cr. Misc. no.83821 of 2023 and order dated 21.6.2024 in Cr. Misc. no.21092 of 2024.
5. The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant. Learned counsel for the informant referring to the contents of the FIR submits that not only the petitioner is named in the FIR but there is direct allegation against him which has been supported by the witnesses in course of investigation.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the

No.1564 of 2025(4) dt.11-04-2025 3/3 petitioner in the FIR, his having remained in custody for 5 months since 25.10.2024, not having any criminal antecedent and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Laheri P.S. Case no.616 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif.
