The petitioner is languishing in custody since 9.8.2019 in a case registered for the offence punishable under Section 392 of the I.P.C.

The accusation against the petitioner is of robbing the motorcycle of the informant by four miscreants including the petitioner who is named in the FIR.

It is submitted by learned counsel for the petitioner that in fact, the informant sold the said motorcycle to the brother of the petitioner and has sworn an affidavit to that effect though subsequent to the registration of FIR, the ownership of the motorcycle in question was transferred in the name of the brother of the petitioner. Patna High Court CR. MISC. No.81243 of 2019(2) dt.11-12-2019 2/2 get back the motorcycle but on refusal by the brother of the petitioner, the false case has been lodged against the petitioner. Learned APP submits that the petitioner is accused in several other cases.

Considering the fact that the investigation has already been concluded, ownership of the motorcycle in question has been transferred in the name of the brother of the petitioner and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV-cum-Sub Judge XIII, Muzaffarpur in connection with Sakra P.S. Case No.82 of 2019.
