JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2019 The petitioner seeks bail in connection with Muffasil P.S. Case No. 378 of 2019, dated 23.07.2019, instituted for the offences under Section 395 of the Indian Penal Code and Sections 25(1-B)a, 26(2) and 35 of the Arms Act. The petitioner has not been named in the F.I.R. and has been remanded in this case on 08.08.2019 on the confession of one of the arrested co-accused persons. There has not been any recovery of incriminating material from the petitioner nor has he been put on test identification parade. In an earlier case in which the petitioner was made accused,

Patna High Court CR. MISC. No.80951 of 2019(2) dt.10-12-2019 2/2 he has been granted bail.

Considering the facts aforestated, the petitioner/Abhi Ram Mahto @ Abhiram Mahto is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 378 of 2019.

The application stands allowed.
