The petitioner seeks bail in a case instituted for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. Prosecution case, in short, is that one country made pistol along with two live cartridges are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.7.2019 and has got no criminal antecedent. Charge-sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner was not apprehended at the spot. The name of the petitioner has transpired on the basis of disclosure made by co-accused. No arms is said to have been recovered from the possession of the petitioner. Other co-

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 66 of 2019 corresponding to G.R. No. 899/2019.
