2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 143, 323, 324, 307, 354, 379, 504 and 506 of the Indian Penal Code.

3. As per prosecution case, these petitioners, along with other accused persons, abused and assaulted the informant and his daughter and took away jewelry and box.

4. It is submitted by learned counsel appearing on

Patna High Court CR. MISC. No.3001 of 2024(3) dt.07-03-2024 2/3 behalf of the petitioners that specific accusation of assault is against co-accused Babloo Yadav. So far as these petitioners are concerned, they are only alleged to have abused the informant and took away the golden earring and cash. It is next submitted that Petitioner No. 1 is brother of the informant, Petitioner No. 4 is brother in law of the informant and Petitioner Nos. 2 and 3 are nephew of the informant and due to a petty dispute, they have falsely been implicated in this case. Petitioner Nos. 1, 2 and 3 claim clean antecedents and Petitioner No. 4 has got one criminal antecedent, in which he is already on bail.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Samastipur, in connection with Warisnagar P.S. Case No.250 of 2023, subject to condition as laid down under Section 438(2) of

Patna High Court CR. MISC. No.3001 of 2024(3) dt.07-03-2024 3/3 the Code of Criminal Procedure.
