JUSTICE SHIVAJI PANDEY ORAL ORDER 16-12-2020 Heard learned counsel for the petitioners and learned counsel for the State through Video Conferencing. In this case, petitioners are seeking anticipatory bail in connection with Mushari P.S. Case No. 236 of 2018 registered for offence punishable under section 304(B) of the Indian Penal Code.

As per allegation made in the FIR, non-fulfillment of the demand of money has been made led to death of Puja Kumari, wife of Sanjay Thakur.

Learned counsel for the petitioners submits that petitioner no. 1 is Nandosi and petitioner no. 2 is Nanad of the deceased and their marriage was solemnised much earlier and even they have son and daughter are married. He further

Patna High Court CR. MISC. No.81063 of 2019(7) dt.16-12-2020 2/2 submits that petitioners have wrongly been implicated in the present case.

Case diary has been called for, no specific allegation has been made against these petitioners.

Looking to the facts and circumstances of the case, petitioners above named, in the event of arrest or surrender before the court below within six weeks from today, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-cum-Sub Judge XVI, Muzaffarpur in connection with Mushari P.S. Case No. 236 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
