The petitioner seeks pre-arrest bail in connection with Banka P.S. Case No. 815 of 2016 registered under Sections 147, 148, 149, 447, 341, 323, 325, 307, 384, 379 and 504 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted by the learned counsel for the petitioner that similarly circumstanced co-accused Dablu Choudhary has already been granted pre-arrest bail by a Bench of this Court vide order dated 11.05.2017 passed in Cr. Misc.

Patna High Court Cr.Misc. No.35759 of 2018 (2) dt.29-06-2018 No.13267 of 2017.

Learned counsel for the State does not controvert the aforesaid submission made by the learned counsel for the State. In that view of the matter, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 815 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
