2. The petitioner seeks regular bail in registered for the offences punishable under sections304(B) and 34 and other allied sections of the Indian Penal Code .
3 As per the prosecution case, this petitioner solemnized marriage with the deceased on 08.07.2019 and since marriage she was subjected to torture and cruelty by her in-laws and husband for the demand of dowry. It is further alleged that on 13.02.2022 , all the accused persons strangulated the deceased to death due to non-fulfillment of demand of dowry .
4. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. The name of the petitioner transpired during the course of the investigation . As a matter of fact, he was not present on the date of the occurrence on the
Patna High Court CR. MISC. No.84 of 2024(3) dt.21-03-2024 2/2 spot. There is no evidence of demand of dowry against this petitioner. Petitioner is in custody since 26.09.2023 . 5 Learned counsel for the State opposes the prayer for bail and submits that petitioner is husband of the deceased and there is direct and specific allegation against him that he used to harass and torture the deceased for the demand of dowry and due to non-fulfillment of the same , she was killed by this petitioner and other accused persons.
6 Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
