JUSTICE BIRENDRA KUMAR ORAL ORDER 13-12-2019 Learned counsel for the petitioner is permitted to correct the date of custody during course of the day. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 137/141/147 of the Railways Act and Sections 401/414 of the Indian Penal Code. Submission is that allegation against the petitioner is that two mobile phones were seized from his possession. The petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 22.07.2019. Investigation of the case is already complete. There is no allegation of tampering with the evidence.

Considering the aforesaid facts, let the petitioner,

Patna High Court CR. MISC. No.82871 of 2019(2) dt.13-12-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Barauni Rail P.S. Case No.80 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
