2. The petitioner apprehends his arrest in a case registered for the offence under Sections 127(1), 115(2), 118(1), 109, 3(5) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
3. Allegation against this petitioner is that he alongwith co-accused Sagar Kumar armed with sharp-cut weapon brutally assaulted son of informant, due to which, he sustained multiple injuries. It is further alleged that when informant came to save her son, they also assaulted informant, due to which, she sustained cut injury on the finger of her left hand and thereafter, both of them threatened informant with dire consequences and fled away.
4. Learned counsel for the petitioner submits that as
Patna High Court CR. MISC. No.89980 of 2024(2) dt.30-01-2025 2/2 per F.I.R., allegation of assault is general and omnibus. The injury, allegedly caused by this petitioner, is simple in nature. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the nature of injury and clean antecedent, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sherghati, District - Gaya in connection with Gurua P.S. Case No. 224 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
