In this case, the petitioner is seeking anticipatory bail in connection with Chapra Town P.S. Case No.171 of 2018, registered for the offence punishable under Sections 409 of the Indian Penal Code.

As per the F.I.R., at the relevant time, the petitioner was Panchayat Secretary. The appointment of Anganbari Sevika and Sahayika was made and he failed to hand over the record of centre nos.150 and 151. It has come to the light that Anganbari Sevika and Sahayikas have got the appointment on the basis of forged documents.

Learned counsel for the petitioner submits that the petitioner has already handed over the record of centre nos. 150

Patna High Court Cr.Misc. No.37065 of 2018(2) dt.03-07-2018 2/2 and 151, inasmuch as, all the Anganbari Sevika and Sahayikas are still working in the centres.

Looking to the aforesaid facts and circumstances of the case, let the petitioner, Namjad Manjhi, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case no.171 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
