The petitioner apprehends his arrest in Bihta P.S. Case No.103/2018, registered under Sections 363, 366(A) and 34 of the Indian Penal Code.

The father of the victim alleged that his daughter went to school but she did not return. During the course of search, he came to know that Rakesh Kumar and Raj Kumar Paswan @ Raja, the petitioner kidnapped his minor daughter for the purpose of marriage.

Learned counsel for the petitioner submits that the victim appeared and made her statement under Section 164 of the Cr.P.C. the court assessed the age of the victim to be 18 years. The victim also disclosed her age to be 19 years. The victim disclosed

Patna High Court Cr.Misc. No.34697 of 2018 (2) dt.03-07-2018 2/2 that she voluntarily left her house to solemnize marriage with Rakesh Kumar. The victim denied the factum of kidnapping. Having considered the fact that victim herself denied the factum of kidnapping, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Danapur, Patna, in connection with Bihta P.S. Case No.103/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
