The petitioner is languishing in custody for the offences punishable under Sections 356/379 of the Indian Penal Code. Later on offence under Section 411 of the Indian Penal Code was added.

The FIR of the offence of theft is against unknown. The petitioner was remanded in this case from some other case. The petitioner is in custody since 28.08.2019. Submission is that there is no substantial material against the petitioner and investigation of the case is already complete.

Finding substance in the submission aforesaid as well as considering the fact that there is nothing to substantiate that

No.83182 of 2019(2) dt.13-01-2020 2/2 the petitioner is tampering with the evidence or abscond the process of law, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bhagwan Bazar P.S. Case No.265 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the Court.
