The petitioner seeks bail in Supaul P.S. Case No. 121 of 2018 registered for the offence punishable under Sections 323, 341, 379, 384, 504, 506/34 of the Indian Penal Code. Informant Pankaj Kumar in his written complaint has stated that on 03.03.2018 at about 4:00 pm he along with his employee Mithilesh Ram was proceeding towards his godown when seven miscreants boarded on three motorcycles stopped them and two miscreants took out pistol and demanded ransom from him and thereafter allegation is that petitioner and four other accused and two unidentified accused started abusing and assaulting the petitioner and thereafter snatched away one golden chain from his neck and Rs. 5000/- from his purse.

Patna High Court Cr.Misc. No.35064 of 2018(5) dt.16-08-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. As per injury report two injuries have been found on the person of the informant which are simple in nature. Petitioner has got no criminal antecedent except one being S.C./S.T. P.S. Case No. 13 of 2018 under Sections 323, 341, 379, 504, 506/34 of the Indian Penal Code and is in custody since 27.04.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul/Incharge Successor Court, in connection with Supaul P.S. Case No. 121 of 2018.
