Petitioners are in custody in connection with Tariyani P.S. Case No. 62 of 2018 for the offence under section 30(A), 38 and 36 of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that petitioners have no criminal antecedent. They are in custody in connection with total 82 liters of counter made wine which was recovered from the maize crops pertaining to different persons and not from the conscious possession of the petitioners or from the field of the petitioners.

The petitioners are in custody since 01.06.2018. Considering the fact that petitioners have no criminal

No.37325 of 2018(2) dt.28-06-2018 2/2 antecedent and they are in custody for nearly one month and liquor was seized from the maize crops, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Sheohar, in connection with Tariyani P.S. Case No. 62 of 2018.
