JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-01-2024 At the outset, learned counsel for the petitioners submits that petitioner no. 1 namely Matukan Yadav has died and as such, he seeks permission to withdraw this petition, so far as petitioner no. 1 is concerned.

2. Accordingly, in respect of petitioner no. 1, this petition is dismissed as withdrawn.

3. The petitioner no. 2 namely Praduman @ Praduman Yadav apprehends his arrest in a case registered for the offence under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code.

4. Scuffle took place between both sides over a petty dispute over drainage, in which, petitioner Praduman Yadav is alleged to have assaulted informant by means of shovel (csypk) and snatched Rs. 2,000/- cash from his pocket.

5. It is submitted on behalf of petitioner that both parties are Gotiyas and due to land dispute between the parties, the alleged incident took place. Injury, caused by this petitioner, has been found to be simple in nature. Petitioner claims clean antecedent.

6. Learned A.P.P. for the State has opposed the bail petition.

7. Considering the aforesaid facts & circumstances, let the petitioner namely Praduman @ Praduman Yadav, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Sandesh P.S. Case No. 18 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
