JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-06-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Panjawara P. S. Case No. 129 of 2017 registered under Sections 148, 149, 323, 327, 384, 504, 308 and 506 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that a bona fide land dispute vide Title Suit No.92 of 2010 is pending between the parties since long and the allegation of crop loot made in the FIR is absolutely false. It is further submitted that the petitioners are agnates of the informant and just

Patna High Court Cr.Misc. No.35599 of 2018 (2) dt.29-06-2018 2/2 in order to take forcible possession on the land of the petitioner, the informant has lodged the instant case.

On the other hand, learned counsel appearing for the State submitted that it is a case of forcible ploughing of the land of the informant and loot of standing crop.

Considering the submissions made on behalf of the petitioners, in the event of arrest or surrender before the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in Panjawara P. S. Case No. 129 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
