2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302, 385 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Earlier, the prayer for grant of anticipatory bail to this petitioner was rejected vide order dated 08.07.2015 passed in Cr. Misc. No. 25241 of 2015.
4. It is submitted by learned counsel appearing on behalf of the petitioner that after dismissal of prayer for grant of anticipatory bail to this petitioner vide order dated 08.07.2015 passed in Cr. Misc. No. 25241 of 2015, the Investigating Officer
Patna High Court CR. MISC. No.5879 of 2025(4) dt.30-04-2025 2/3 has submitted final form against this petitioner finding him innocent and he was not sent up for trial. However, differing with the same, the learned trial court has taken cognizance against this petitioner. It is further submitted that even as per F.I.R., the deceased has been shot in a Bolero car by co-accused Murgi Miyan and this petitioner is only alleged to have called on mobile phone of brother of informant under the pretext of generator supply and except this, there is absolutely no allegation against this petitioner of any overt act. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the subsequent developments in the case, the fact that final form has already been submitted and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Siwan in connection
