On getting confidential information, a Bolero Jeep bearing registration No. JH-05HE-6011 was intercepted at Amas Toll Plaza having occupied by the driver Sonu Pal and Dharmendra Yadav regarding transportation of Ganja and when searched out in presence of the Magistrate Ram Kumar Raman, 60 packets (each containing 2 Kgs.) totalling 120 Kgs. Ganja was seized. On interrogation, Dharmendra Yadav disclosed that the aforesaid Ganja was given by Rohit Kumar @ Anil at Orissa, who instructed to come to Nokha where he will meet. It has further been disclosed that just now Rohit Kumar, Ravikant Dubey and Rahul Kumar, who are the owners of the aforesaid Ganja, have informed that they are to

No.80163 of 2019(2) dt.06-12-2019 2/2 meet at Nokha, whereupon the police party also accompanied and at Nokha the aforesaid three persons, namely, Rohit Kumar, Ravikant Dubey and Rahul Kumar (petitioner) have been arrested on account of having their appearance near about the vehicle when it was parked at Nokha.

Nothing has been recovered from the possession of the petitioner though, his name appeared on a confidential information of a co-accused, more or less admissible in terms of Section 67 of the Act. However, having absence of the criminal antecedent as per para-3 and being under custody since 2.8.2019, the petitioner, Rahul Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IV, Gaya in Amas P.S.Case No. 150/2019, N.D.P.S.Case No. 3/19/53/19.
