Petitioner, who is in custody, seeks bail in connection with Banka P.S. Case No. 192 of 2018 registered for the offences punishable under Sections 420, 419, 467, 468, 385, 120(B) and 504 of the Indian Penal Code.
Informant in his written complaint has stated that they have an ancestral land and informant has been made caretaker of the said land. It has been submitted by the informant that at present he is looking after the land and prior to him, his father was looking after the land. The accused persons are claiming title over the land and the claim of accused was scrutinized by the police personnel and his documents were found to be forged and thereafter accused
Patna High Court Cr.Misc. No.39119 of 2018 (4) dt.28-08-2018 tried to dispossess the informant from the land and as such present case has been filed.
It has been submitted on behalf of the petitioner that he is innocent and title suit regarding title and possession over the disputed land is pending in civil court, which has been filed by the father of petitioner. Petitioner has no criminal antecedent and he is in custody since 17.04.2018.
Considering the aforesaid fact and circumstances of the case let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Banka P.S. Case No. 192 of 2018.
