JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Agioun (Garahani) P. S. Case No. 100 of 2019 disclosing offences under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R. while the son of the informant was going on, he was not allowed to go from that passage and there is allegation that other accused persons came and caught hold of him and wife of the petitioner assaulted by a sharp cutting weapon, causing injury.

Submission of the learned counsel for the petitioner is that there is a land dispute between the parties with respect to passage and allegation against two persons of assault including the wife of the petitioner whereas only one injury was found that too lacerated.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of A.C.J.M.-II, Bhojpur at Ara, in connection with Agioun (Garahani) P. S. Case No. 100 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
