The petitioner is in custody since 06.03.2018 in connection with POCSO P.S. Case No. 22 of 2018, arising out of Barhara (Krishnagarh) P.S. Case No. 316 of 2017 for the offence registered under Sections 341,342,323,354(B)/34 of the Indian Penal Code and later on Section 12 of the POCSO Act has also been added.

Learned counsel for the petitioner submits that the petitioner is named in the FIR, but no specific role has been attributed to him. There is allegation against him that he was also present and had come with the Magic Vehicle driver who had come on a motorcycle to the house of the maternal uncle of the informant. It is further submitted that after his anticipatory bail

Patna High Court Cr.Misc. No.36772 of 2018(2) dt.10-07-2018 2/2 application was dismissed by this court, the petitioner has surrendered and made prayer of regular bail.

Considering the aforesaid facts and circumstances of the case and also because he has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with POCSO Case No. 22 of 2018, arising out of Barhara (Krishnagarh) P.S. Case No. 316 of 2017.
