1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2) and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 09.08.2025 at around 11:30 AM, he had gone to his sister's house on even of Rakshabandhan when Rahul and Vishal both brothers of his brother-in-law came and assaulted him by sharp edged weapon causing injury on head and hand.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.87784 of 2025(2) dt.22-01-2026 2/3 petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that petitioners are own brothers of the husband of the sister of the informant. It is next submitted that informant was trying to oust the petitioners from the house by taking his sister into confidence, as such, there was unrest in the family and when informant came on the eve of Rakshabandhan, an altercation took place in which both sides assaulted each other. It is also submitted that injury suffered by the informant has been opined to be simple and petitioners are not criminals and will not abscond rather will cooperate in the investigation to prove their innocence. It is next submitted that from side of the petitioners also Chowk P.S. Case No. 316 of 2025 has been instituted against the informant, his sister and brother-in-law i.e. (brother of the present petitioners)
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.87784 of 2025(2) dt.22-01-2026 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chowk P.S. Case No. 315 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
