The petitioner apprehends his arrest in Sasaram (T) P.S. Case No.506 of 2019 registered under Sections 498A, 341, 323, 504 and 34 of the Indian Penal Code.

The petitioner is the husband.

The learned counsel for the petitioner submits that petitioner is ready to keep his wife. Petitioner never demanded any dowry nor tortured his wife.

Mr. Dineshwar Mishra, learned counsel for the informant as well as learned A.P.P. submit that wife is ready to restore conjugal relation.

Taking into consideration the fact that husband and

No.84675 of 2019(3) dt.19-06-2020 2/2 wife are ready to restore their conjugal relations, let the petitioner, above named, is directed to surrender before the court below within a period of four weeks from the date of receipt of the order and on such learned court below shall enlarge the petitioner on provisional bail for six months on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram(T) P.S. Case No.506 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Thereafter, the learned court below shall take all efforts for resolution of the dispute between the husband and the wife and if the dispute between the husband and the wife is resolved, the provisional bail granted to the petitioner shall be confirmed. If the dispute between the husband and the wife is not resolved without the fault of the informant, learned court below shall pass order on the provisional bail of the petitioner in accordance with law immediately after lapse of six months.
