====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-07-2018 Heard the counsels for the parties.

The petitioner seeks bail in connection with Begusarai (Town) P.S. Case No. 182/2018 dated 04.04.2018 instituted for the offences under Sections 381 and 34 of the Indian Penal Code. Theft was continuously being committed in the garment shop of the informant about which the informant had knowledge. However, the case was lodged after one month. The petitioner is one of the employees of the informant and from his possession, certain garments belonging to the informant has been recovered. The learned counsel for the petitioner has submitted that though the informant was running a garment shop, but he had permitted his three staff to sell the clothes in the market on their own. In fact, those clothes were purchased by the staff of the

There appears to be, it has been argued, some dispute in the accounting and therefore as a vindictive measure, the petitioner, who was one of the staff of the informant, has been made accused in this case.

The petitioner is in custody since 09.04.2018. Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai (Town) P.S. Case No. 182/2018.
