The petitioner seeks bail in connection with Goshwari P.S. Case No. 18 of 2017, registered under Sections 341, 323, 307, 504, 120B, 115 and 34 of the Indian Penal Code and 27 of the Arms Act.
The accusation is that on 31.03.2017 informant, Rejki Ram, was at his door, at that time, four persons, named in the first information report, including the petitioner (Santosh Ram), Krishna Ram, Bijo Ram and Chandan Ram came Krishna Ram ordered to kill. When, informant made query about the matter, then, Chandan Ram fired through pistol causing injury at his neck. At that time, Santosh Ram (petitioner) and Bijo Ram also made indiscriminate firing.
Submission is that specific allegation is against
Patna High Court CR. MISC. No.86719 of 2019(2) dt.18-01-2020 2/2 Chandan Ram to fire through pistol at the neck of the informant, with further allegation that Santosh Ram (petitioner) and Bijo Ram also made indiscriminate firing, but, only one fire arm injury was found on the neck of the informant. Further, submission is that the petitioner has no criminal antecedent and is in custody since 16.09.2019.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Goshwari P.S. Case No. 18 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, IV, Barh, Patna. (Rajendra Kumar Mishra, J) Shamshad/- U T
