JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 26.1.2018, seeks bail in Naubatpur PS Case No. 28 of 2018 registered under Sections 399, 402 of the IPC and Sections 25(i)9b)A, 26 and 35 of the Arms Act. The allegation in brief is that the police on secret information regarding assembly of some criminals making plan for committing dacoity raided the place and some arms were recovered from some of them but only four cartridges are alleged to have been recovered from the possession of the petitioner.
Learned Counsel for the petitioner submits that the implication is false, only four cartridges are said to have been recovered from the possession of the petitioner with no fire arm and this petitioner has no criminal antecedent and has been in custody since 26.1.2018.
Having considered the said facts and circumstances, the petitioner, namely, Rahul Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II, Danapur, Patna in connection with Naubatpur PS Case No. 28 of 2018.
