The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 379, 504, 354 and 37(c) of the Bihar Prohibition and Excise Act, 2016.
Prosecution case, in short, is that the petitioner misbehaved with the informant' s mother in drunken state and taken away golden chain from her neck.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.05.2019. Charge sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this
Patna High Court CR. MISC. No.83227 of 2019(2) dt.16-12-2019 2/2 case. The informant happens to be the agnate of the victim. Due to property dispute the present case has been instituted. The petitioner is said to have misbehaved in drunken state. There is no recovery of liquor from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Bypass P.S. case No.132 of 2019, Special case No.4678 of 2019.
