Petitioner apprehends his arrest in connection with Sessions Trial No. 04 of 2016, arising out of Rajpur P.S.Case No. 78 of 2013 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the FIR and later on one person was arrested, who has named this petitioner in his confessional statement and on trial the accused, who has confessed, on trial has been acquitted. It appears that after five years the prosecution has filed a petition for issuance of warrant of arrest against the petitioner.

Submission of learned counsel for the petitioner is that except confessional statement there is absolutely nothing against

Having heard both sides and in the facts and circumstances, let the petitioner, above named, surrender within a period of six weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-VI, Buxar, in connection with Sessions Trial No. 04 of 2016, arising out of Rajpur P.S.Case No. 78 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in investigation as well as in trial, otherwise his bail bond shall be cancelled.
