The petitioner is in custody in connection with Motipur P.S. Case No. 434 of 2017 for the offence under Sections 30(A), 38(1) and 41of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner was arrested in connection with seizure of 185.4 liters liquor. Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner in fact it was recovered from the road side, on account of suspicion petitioner has been made accused in the instant case. Patna High Court Cr.Misc. No.39305 of 2018(2) dt.09-07-2018 2/2 granted bail by another co-ordinate bench of this court vide Cr. Misc. No. 6626 of 2018 by order dated 17.02.2018. Considering the fact that the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Muzaffarpur, in connection with Motipur P.S. Case No. 434 of 2017.
