====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-02-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 332, 333, 307, 353, 355, 379, 411, 504/506 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, on secret information, police conducted a raid and apprehended some persons who were involved in illegal extraction of soil and sand and seized JCB machines and tractors. It is further alleged that during raid, accused persons attacked the police party and made firing on them in which SHO of police station was seriously injured. Apprehended accused persons took name of the petitioner as their accomplice.
4. Learned counsel appearing for the petitioner submits that the petitioner was not present on the spot and he is innocent and has falsely been implicated in this case.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.1815 of 2025(2) dt.12-02-2025 2/2 for bail. He submits that the petitioner is named in the FIR with specific allegation that he and other accused persons were engaged in illegal excavation of sand and soil and when police party raided the place of occurrence, they attacked and made firing on the police party as a result of which SHO of police station sustained injuries. Petitioner has got four criminal antecedent.
6. Since, petitioner is alleged to have involved in attack on a police party and he has criminal antecedent, prayer for bail of the petitioner is rejected.
