JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 The petitioner seeks regular bail in connection with Dhanarua P.S. Case No. 214 of 2019, registered for offences punishable under Sections 302 and 120(B) of the Indian Penal Code.

Allegation against the petitioner is of assault to the father of informant by wooden plank causing his death. It has been submitted on behalf of the petitioner that the deceased was the brother of petitioner and F.I.R. itself disclosed that due to some dispute the occurrence took place and there was no intention of the petitioner to kill the deceased, which will appear from the fact that there is no repetition of blow and the occurrence took place in the spur of moment and petitioner has been in custody for more than six months. Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IX, Patna, in connection with Dhanarua P.S. Case No. 214 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
