2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Rafiganj P.S. Case No. 260 of 2023 instituted for the offence punishable under Sections 420 and 406 of the Indian Penal Code.

3. As per complaint petition, accused nos. 1 to 3 namely Md. Imran, Satendra Prasad and Dinesh Kumar formed a company namely Meta Infra Ltd., which was being operated by co-accused, Md. Imran, being the director along with other

It is further alleged that the alleged company had fled away after grabbing Rs. 7 crores of the investors in the same company. It is also alleged that the petitioners abused and threatened to kill the complainant when asked about the invested amount.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. Petitioners have no concern with the alleged company and petitioner no. 1 has implicated in this case only because he is the brother of co-accused Md. Imran, who is the operator and director of the alleged company. Petitioner no. 3 is the friend of petitioner nos. 1 and 2 and thus petitioners have not cheated the complainant. They are neither the office bearers nor concerned in any manner related with the affairs of the said company. Petitioners have got no criminal antecedent.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a

Patna High Court CR. MISC. No.87379 of 2025(2) dt.24-12-2025 3/3 period of four weeks from today and in the event of their arrest or surrender in connection with Rafiganj P.S. Case No. 260 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down under section 482(2) of the BNSS.
