====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-01-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 147, 323, 504, 304(B), 120(B) of the IPC and 3⁄4 of the D.P. Act.

Allegation against the accused person is of committing torture and assault and thereafter caused death of the victim due to non-fulfilment of demand of dowry. Earlier anticipatory bail application of the petitioner was rejected by this Court vide Cr. Misc. No. 55327 of 2018 under order dated 14.12.2018, vide Annexure-1 to the present application.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.81471 of 2019(2) dt.17-01-2020 2/2 present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is the husband of the victim. Learned counsel for the petitioner has submitted that the deceased had died due to illness. A compromise petition has also been filed by the informant in the learned court below which is Annexure-4 to the present application.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R/ complaint case.

Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-2, Jamui, in connection with Sikandra P.S. Case No. 154 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
