1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Cyber P.S. Case No. 48 of 2024 registered under sections 379, 419 and 420 of the Indian Penal Code and sections 66(C) and 66(D) of the I.T. Act.
3. As per the prosecution case, the total of Rs. 5,26,075/- was debited from the account of the informant and credited to other accounts without the consent of the informant. As such, the informant reported the occurrence of cyber crime to the police authorities leading to registration of FIR against unknown.
4. Learned counsel for the petitioner submits that out
Patna High Court CR. MISC. No.1030 of 2025(5) dt.09-06-2025 2/3 of total amount stated by the informant, a total sum of Rs. 1,50,000/- was credited to the petitioner's account without his consent nor did he have any knowledge about the same. Subsequent to the order dated 15.4.2025 passed by this Court, the petitioner has returned the aforesaid amount of Rs.1,50,000/- which would be evident from the order dated 2.5.2025 passed by the learned Court below by the Chief Judicial Magistrate and a copy of which has been brought on record as supplementary affidavit filed on behalf of the petitioner. He is in custody since 21.7.2024, charge-sheet has been submitted in the case and he has no criminal antecedent.
5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR together with the contents of the supplementary affidavit from which it transpires that the aforesaid amount of Rs.1,50,000/- has been returned, petitioner having remained in custody since 21.7.2024 and his not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Cyber P.S. Case no. 48 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two
