The petitioner is accused in connection with Excise Case No. 28 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that on receiving secret information about keeping the illicit liquor by the petitioner in village Maur, the informant along with other police personnel reached there and recovered 36 bottles each containing 750 ml and 168 bottles each containing 375 ml Indian made foreign liquor from the open filed, while petitioner succeeded to flee away.

No.81923 of 2019(2) dt.16-01-2020 2/2 Learned counsel for the petitioner submits that it would appear from the FIR that the alleged seized bottles of Indian made foreign liquor were recovered form the open field and the petitioner was not apprehended at the spot. Further submission is that petitioner is accused in four others cases, in similar nature due to that reason, he has falsely been implicated in the present case mere on suspicion and petitioner is in custody since 30.08.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Sheikhpura in connection with Excise Case No. 28 of 2019.
