The petitioner seeks anticipatory bail in connection with Complaint Case No. 3335 ( C )/2016, registered for offences punishable under Sections 494, 495, 420 and 120 B of the Indian Penal Code.
Allegation against the petitioner is that his marriage was solemnized with the complainant and for this, heavy amount was paid by the father of the complainant but thereafter the petitioner started demand of flats and Honda City Car from the
Patna High Court Cr.Misc. No.38522 of 2018 (2) dt.03-07-2018 2/3 complainant. It is further alleged that the petitioner had illicit relation with one Sonali Priya and had already married for whom a case had been lodged under Sections 498A by the complainant against the petitioner, which would appear from Annexure-2 series and thereafter, the present case has been filed. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in that case the petitioner is ready to abide all the terms and conditions as laid down under Section 438 ( 2) Cr.P.C.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each in connection with Complaint Case No.3335C of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate- VIII, Patna , subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned and petitioner shall cooperate in the
Patna High Court Cr.Misc. No.38522 of 2018 (2) dt.03-07-2018 3/3 investigation and shall be present before police as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bonds.
