The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 452 of 2019, registered under Sections 147, 148, 323 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that nine persons named in the FIR including the petitioner and 4 to 5 unknown having sword, iron rod and rifle in their hand made attempt to kill the informant. At that time, Rishi Paswan shot fire through gun but the same was not hit to the informant.
Learned counsel for the petitioner submits that while the petitioner is named in the FIR but no specific overt act
Patna High Court CR. MISC. No.85186 of 2019(2) dt.10-01-2020 2/2 has been attributed against him but due to dirty village politics the name of the petitioner has surfaced in the present case. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Muffasil P.S. Case No. 452 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
