Petitioner is in custody in connection with Barahara P.S. Case No. 209 of 2018 for the offence under section 30(a) Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has been arrested in the instant case in connection with seizure of 39 liters of liquor.

Learned counsel submits that mandatory provision of Section 100 Cr.P.C. was not followed in the matter of preparation of seizure list. He further submits that petitioner is in custody since 25.5.2018.

Considering the fact that petitioner is in custody since 25.5.2018 and nothing was recovered from the personal

Case No. 209 of 2018, Excise Case No. 904 of 2018.
