2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 285 , 286, 427 and 34 of the I. P . C . and Section 3 , 4, 5 of the Explosive Substances Act 1908 .

3. As per the prosecution case, on 02.10.2023 , on hearing the sound of an explosion, the patrolling party arrived at the place of occurrence, where it was informed that this petitioner, along with other co-accused persons, were involved in the illegal production of fire crackers,

Patna High Court CR. MISC. No.2592 of 2024(3) dt.07-03-2024 2/3 and during the course of manufacturing, one bomb exploded in which some of the persons sustained injuries and nearby houses were damaged.

4. It is submitted on behalf of the petitioner that he has falsely been implicated in this case due to dirty village politics. No incriminating material has been recovered from the possession or from residence of the petitioner. He is no way involved in the illegal manufacturing of the alleged fire crackers. Lastly, he submits that petitioner has been made accused in this case because he happens to be relative of co-accused Shama Begum.

5. Learned counsel for the State vehemently opposes the prayer for bail and submits that petitioner is indulged in the manufacturing of illegal fire crackers and due to explosion some of the villagers sustained injury and also the nearby houses were damaged. He next submits that explosive substance were also found at the place of occurrence .
