Petitioner seeks bail in connection with Ara Town P.S. Case No. 492 of 2016 for offences punishable under Sections 419 and 420 of the Indian Penal Code. The prosecution case, as lodged by the Head Master and Head Incharge of the Examination being conducted of the Central Selection Council Bihar, is that one Sumanjay Kumar was found in the examination hall impersonating the petitioner on his roll number for the said examination.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and both petitioner and the co-accused Sumanjay Kumar are brothers and that he has already been granted the privilege of

Patna High Court Cr.Misc. No.40889 of 2018(3) dt.13-07-2018 2/2 bail by a co-ordinate Bench of this Court in Cr. Misc. No. 48811 of 2016 vide order dated 13.12.2016. The petitioner has surrendered and is languishing in judicial custody since 05.04.2018.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 492 of 2016.
