The petitioners are apprehending their arrest in connection with Amarpur PS Case No. 516/2017 for the offence under Sections 341, 323, 308, 506 and 34 of the Indian Penal Code pending before the Chief Judicial Magistrate, Banka. Learned counsel appearing for the petitioners would submit that the petitioners and the informant are gotias. There is land dispute against them and out of the land dispute scuffle took place in which both sides sustained injuries. Considering that the petitioners have no criminal antecedent and the fact that there is case and counter-case on
Patna High Court Cr.Misc. No.40973 of 2018(3) dt.11-12-2018 2/2 account of land dispute, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Amarpur PS Case No. 516/207 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
