The petitioner in the present writ application seeks following reliefs :- (I) For directing the respondent authorities to release the Truck of the petitioner bearing Registration No. JH10AW-2231 which has been seized by the respondent authorities under the Provisions of Bihar Mineral (Concession, Prevention of Illegal Mining, Transportation and Storage Rules, 2019 as amended up to 2021 Rules.

(ii) For directing the respondents to proceed with the proceeding for confiscation/auction of the above vehicle in question.

3. Considering the nature of request being made by the counsel for the petitioner, the case is disposed of with the consent of both the parties at this stage itself.

4. Learned counsel for the petitioner submits that a penalty of Rs.3,29,821/- has been imposed for which the petitioner is ready to pay, however, he expresses difficulty in paying the said amount in one go and hence prays for some accommodation.

5. Prayer being made by the petitioner is not opposed by the Mines Deptt. as well as by the State.

6. Considering the request of the petitioner, the petitioner is directed to deposit the penalty amount of Rs. 3,29,821/- in three equal monthly installment starting from first of July, 2025. After the third installment has been paid within one week, the vehicle / truck of the petitioner bearing Registration No. JH-10AW-2231 shall be released in favour of the petitioner.

7. It is made clear that default in payment of installment will disentitle the petitioner for release of the vehicle in question.

8. With the aforesaid observation and direction, the present writ application is disposed of.
