Petitioner prays for bail in connection with Forbesganj (Simraha) P.S.Case No. 607 of 2014, corresponding to Sessions Trial No. 07 of 2015, registered for the offences punishable under Sections 448 and 376 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected by the then co-ordinate Bench of this Court vide order dated 9.11.2015 passed in Cr.Misc.No. 32603 of 2015 and allegation of rape is against the petitioner.

Submission of learned counsel for the petitioner is that petitioner is in custody for about four years and as such lenient view may be taken.

Heard learned APP also and perused the report of the

Patna High Court Cr.Misc. No.40805 of 2018 (4) dt.25-09-2018 2/2 court below from which it appears that the case is at the stage of defence evidence.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it as soon as possible. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U T
