JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Sherghati (Dobhi) P.S. Case No.296 of 2018 for the offences under Sections 272, 273 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent. The petitioners are in custody since 01.06.2018 in connection with seizure of 60 litres of liquor. Learned counsel submits that nothing was recovered from the conscious possession of the petitioners.
Considering the fact that the petitioners have remained in custody for more than one month and they have no criminal antecedent, the petitioners, named above, are directed to
Patna High Court Cr.Misc. No.40038 of 2018 (2) dt.10-07-2018 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Gaya in connection with Sherghati (Dobhi) Police Station Case No.296 of 2018.
