Petitioner seeks bail in connection with Kesariya P.S. Case No. 81 of 2018 registered for the offence punishable under Sections 452, 376, 511 and 379 of the Indian Penal Code. Allegation against the petitioner is of attempting to commit rape on the daughter of the informant in the midnight of 23/24.03.2018 and also snatching away a golden chain from the neck of his daughter. He was apprehended by the villagers when he was fleeing away.
It has been submitted on behalf of the petitioner that the petitioner is next door neighbour of the Informant and there is dispute with regard to refund of loan provided to the Informant. Petitioner has got no criminal antecedent and is in
Patna High Court Cr.Misc. No.40040 of 2018(3) dt.18-09-2018 2/2 custody since 25.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-11, Motihari, East Champaran, in connection with Kesariya P.S. Case No. 81 of 2018.
