JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Sangrampur P. S. Case No. 37 of 2014, disclosing offences under Sections 366A/34 of IPC. Allegation against the petitioner is that he along with other accused persons kidnapped the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that as a matter of fact, the victim had married with one Rajesh Kumar and he has falsely been implicated in this case. He is a Teacher. Moreover, a compromise has been reached between the parties, which will appear from Annexure 3.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that petitioner is named in

Patna High Court CR. MISC. No.85475 of 2019(2) dt.22-01-2020 2/2 the F.I.R. and the case is of 2014, which shows that he was absconding since then.

Having heard both sides, considering the submissions, made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail, the same shall be considered on the basis of the materials available on the record and also of submissions that compromise has been reached between the parties and be disposed of without being prejudiced by this order and if, possible to the disposed of on the same day.
